1.The State Council Issues the Notice on Active Measures to Expand Opening Up and Use Foreign Funds

On 17th January 2017 the State Council issued the Notice on Active Measures to Expand Opening Up and Use Foreign Funds in order to clarify opening up and foreign fund use policies and create a fair and favorable market environment.

2.The State Administration for Industry and Commerce Publishes the Opinions on Comprehensive Promotion of the Simplified Registration Cancellation Policy

On 29th December 2016 the State Administration for Industry and Commerce published the Opinions on Comprehensive Promotion of the Simplified Registration Cancellation Policy, which will be put into effect on a national scale as from 1st March 2017. Limited liability companies, non-corporate legal entities, sole proprietorship or partnership businesses that haven’t done any business activity (not open for business) since having the business license or have no debts or have settled all debts owed by or to them before applying for registration cancellation can choose between the general cancellation process and the simplified cancellation process.

3.The State Administration for Industry and Commerce Publishes the Provisional Rules on Unconditional Return of Commodities Bought from the Internet within Seven Days

On 6th January 2017 the State Administration for Industry and Commerce published the Provisional Rules on Unconditional Return of Commodities Bought from the Internet within Seven Days, which will take effect as from 15th March 2017.

The Rules sets out the types of commodities to which the return policy does not apply, standards on deciding if a commodity is good enough to be returned, processes relating to the return of commodities and detailed punishment rules for internet dealers violating the Rules.

4.The State Administration for Industry and Commerce Publishes the Revised Edition of the Trademark Review and Approval Criteria       

On 5th January 2017 the Trademark Office of the State Administration for Industry and Commerce published the revised edition of the Trademark Review and Approval Criteria, to which the sound trademark review criteria, the use of review opinion reports rules, etc. are added.

5.The Cosmetics Safety and Technical Standards Take Effect on 1st December 2016

Production or importing of cosmetics that fails to meet the Cosmetics Safety and Technical Standard (“Standard”) is prohibited since 1st December 2016. Related products can be sold until their shelf life expires. Packages that only involve a change of product use conditions and dos & donts shown on the package labels as required can be used until 30th June 2017. Related products can be sold until their shelf life expires.

Prior approved or registered cosmetics whose formula need adjusting according to the Standards should be filed in a change application with the food and drug authority.

6.China Food and Drug Administration and the General Administration of Quality Supervision, Inspection and Quarantine Co-Issue the Notice on the Pilot Administration Rules on Filing Imported Cosmetics for Non-Special Use with the Authority of Pudong New Area, Shanghai

On 17th January 2017 China Food and Drug Administration and the General Administration of Quality Supervision, Inspection and Quarantine co-issued the Notice on the Pilot Administration Rules on Filing Imported Cosmetics for Non-Special Use with the Authority of Pudong New Area, Shanghai. According to the Notice, the new registration system for non-special cosmetics imported through the customs of Pudong New Area in Shanghai for the first time will be put into use from 1st March 2017 to 21st December 2018, replacing the current approval system..
