I. The General Office of the State Council Issued Several Opinions on Promoting Steady Growth of Foreign Trade.
The General Office of the State Council issued the Several Opinions on Promotion of Steady Growth of Foreign Trade of the General of Office of the State Council (the “Several Opinions”) on 18, September, 2012, which provide 16 opinions to promote steady growth of foreign trade in 2012, including doing well with export tax refund and financial service, developing trade facilitation, improving trade environment, optimizing the trade structure and other areas. And the policies of export tax refund and export credit insurance are the hot issues attracting the attentions. The experts said the following detail implementation measures and provisions would be promulgated soon for the implementation of the Several Opinions.

II. The Ministry of Finance and the National Development and Reform Commission Jointly Issued the Cancellation of the Charge for Customs Supervision in Imports and Exports Since 1, October.
Recently, for the effective implementation of the Several Opinions on Promotion of Steady Growth of Foreign Trade of the General of Office of the State Council, the Ministry of Finance and the National Development and Reform Commission jointly released the Notice on Cancelling and Exempting the Administrative Charge for Imports and Exports (the “Notice”), which definitely provides the cancellation of Customs Supervision since 1, October, 2012, and the exemption of charge for the entry-exit inspection and quarantine of all the entry-exit goods, transportation, container and statutory objects during 1, October, 2012 to 31, December, 2012 ( excluding the expenses charged for the vaccination and physical examination of entry-exit personnel, as well as the expenses of the matters related with entry-exit inspection and quarantine such as the commercial inspection and identification voluntarily appointed, entry-exit inspection and quarantine treatment, and animal immunization, which shall beard by the enterprises and institutions).

III. The State Administration of Taxation Issued the Administrative Measures for Tax Refund (Exemption) at Ports of Departure .
The State Administration of Taxation issued the Administrative Measures for Tax Refund (Exemption) at Ports of Departure ( the” Administrative Measures”) on 24, August, 2012, which have been executed on 1, August, 2012. On June, 2012, the Ministry of Finance, the General Administration of Customs and the State Administration of Finance jointly announced the policy of tax refund at ports of departure in Shanghai to support the Shanghai to develop modern service industry and advanced manufacturing industry and to become the international financial and shipping center, so the Administrative Measures is issued as one of the detail implementation measures of such policy, and provides the operation details by the export enterprises and tax authority in the procedure of record, declaration, review and approval, re-examination and so on.

IV. The Amendment of the Civil Procedure Law has been Adopted and will takes into Effect on 1, Janurary, 2012.
On 31, August, 2012, the Decision of Standing Committee of the National People’s Congress on Amending the Civil Procedure Law of the People’s Republic of China (2012) has been adopted and published, and the amended Civil Procedure Law will take into effect on 1, January, 2012. The amendment draft covers a range of regulations such as the addition provisions of relief procedure of victims, pro-bono litigation, small claims and meritless litigation as well as the amended provisions of application for protest and retrial.
