Would Tencent Take the Copyright of Contents Published by Users on WeChat?


(By You Yunting) Recently, a news report titled “My WeChat, But Not My Copyright?” (note: the article is in Chinese) has raised wide suspicion over the copyright of the messages posted on WeChat, a LBS messaging software by Tencent. The reporter checked the User Agreement of Tencent and interviewed a representative from the company. Unfortunately, ultimately the reporter was still unable to reach a conclusion  on the copyright ownership for messages posted on WeChat.

The author also examined the User Agreement of Tencent’s WeChat, and verified the dou
bt of the reporter. With regards to the copyright ownership of the content published by the user, Tencent’s User Agreement included very little information  and does not answer the question. To perform Psy’s signature “horse-riding” dance has become an integral part of domestic corporate annual galas in China. In fact, the partners of our law firm have been encouraged by colleagues to perform the dance for everyone’s amusement. According to a recent news report (note: the link is in Chinese), the Huanju Inc (namely duowan.com), the holding company of YY.com submitted the prospectus to SEC of USA, applying for the IPO in NASDAQ for $ 100 million funding, and the code of it is YY. As indicated in the prospectus, the achievements of YY music have been the most bling-bling part. YY music is actually the music channel of YY instant messenger, introduced in March of 2011, and mainly broadcasting live shows of music performance. The performer could interact with the spectators by Karaoke, singing match or live videos. Furthermore, amounts of virtual products are available on YY music, which could be got on payment or as gifts. Yet to the statement of someone skilled in the art, the mode of YY music is facing the copyright risk. Today’s post would share our opinions on the issue.
