Would Tencent Take the Copyright of Contents Published by Users on WeChat?


(By You Yunting) Recently, a news report titled “My WeChat, But Not My Copyright?” (note: the article is in Chinese) has raised wide suspicion over the copyright of the messages posted on WeChat, a LBS messaging software by Tencent. The reporter checked the User Agreement of Tencent and interviewed a representative from the company. Unfortunately, ultimately the reporter was still unable to reach a conclusion  on the copyright ownership for messages posted on WeChat.

The author also examined the User Agreement of Tencent’s WeChat, and verified the dou
bt of the reporter. With regards to the copyright ownership of the content published by the user, Tencent’s User Agreement included very little information  and does not answer the question. As regulated in Article 11.1 of Tencent Service Agreement and Article 9.1 of Tencent Public Platform Service Agreement:

— A trademark certificate cannot be taken as evidence of copyright ownership

(By Luo Yanjie) On June 27th 2002, Hua Yuan Company (hereinafter “Hua Yuan”) filed an application to revoke the disputed trademark “老人城LAORENCHENG” (hereinafter Lao Ren Cheng) pursuant to on Article 31 of the Trademark Law, with the claim that the trademark infringed upon Hua Yuan’s first rights in the mark. The disputed trademark was applied in Class 25 with registration number 1497462. During prosecution of the trademark, Hua Yuan submitted certificate of the No. 590673 trademark and No. 696935 trademark as evidence of its first rights in the mark. As indicated by the documents, the trademarks were registered before the trademark “Lao Ren Cheng.” Considering the opposition was mainly filed on the ground that Hua Yuan’s first rights had been infringed rather than due to similarity of the trademarks, the focus of this particular case depends on whether a trademark certificate may be treated as evidence of trademark ownership.


Copyright Issues behind Disputes on Beijing Love Story

The popular TV drama Beijing Love Story (the “Story”) has become the hot topic of  social discussion. The discussion was triggered about with whom the copyright  ownership of the story resides, on which both editors Chen Sicheng and Li Yaling claimed the right over it.  Chen planned to shoot a film of the Story which Li was against, with the reason that any licenses of the works shall have to go through her approval and that she will have to be paid  remuneration. With the  escalation of the dispute, both parties seek the settlement through legal ways.
